These Terms and Conditions (“Terms”) apply to all purchases of food, beverages, and products (“Products”) from Wicked Angel Cafe (“we”, “our”, “us”). By making a purchase, you agree to these Terms.
1. General
Wicked Angel Cafe is located in Darlinghurst, NSW. These Terms apply to all purchases made in our café, over the phone, online, or via delivery partners. We may update these Terms from time to time. The latest version will be available on our website or upon request in-store.
2. Prices & Payment
All prices are in Australian Dollars (AUD) and include GST unless stated otherwise. Prices may change without notice, but confirmed orders will not be affected. Payment must be made at the time of purchase by cash, card, or other accepted methods. For online or advance orders, payment is required before the order is prepared.
3. Orders
Orders are subject to availability. We reserve the right to refuse or cancel an order if :The product is unavailable, payment is not authorised, or there is an error in pricing or description.
4. Refunds & Returns
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to: A replacement or refund for a major failure, compensation for any reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. We do not provide refunds for change of mind, incorrect choice, or failure to collect orders, unless required by law.
5. Allergies & Dietary Requirements
We take care to prepare food safely but cannot guarantee our Products are free from allergens (including nuts, gluten, dairy, or other common allergens). Customers are responsible for informing us of any allergies or dietary requirements at the time of ordering. We accept no liability for adverse reactions caused by food or beverages consumed at our café or from takeaway/delivery.
6. Gift Cards & Vouchers
Gift cards and vouchers are non-refundable and cannot be redeemed for cash. Expiry dates and conditions are stated on each card or voucher.
7. Online & Delivery Orders (if applicable)
Delivery times are estimates only and may vary due to external factors. We are not responsible for delays caused by third-party delivery providers. Risk of loss or damage passes to you once the Products leave our café.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for: Any indirect or consequential loss ,Loss arising from misuse of our Products, or Events outside our reasonable control. Nothing in these Terms excludes or limits your rights under the ACL.
